Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) form a binding agreement between you and Barddle Inc (“Barddle,” “we,” “us”) governing your use of the Barddle service at barddle.com(the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

• You must be at least 18 years old to use Barddle.
• You agree to provide accurate information during signup and to keep it current.
• You are responsible for maintaining the confidentiality of your password and for all activity under your account.
• One account per person. You may not share or transfer your account.

3. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to access, scrape, reverse-engineer, or interfere with the Service or any user’s account.
• Submit content that is harmful, harassing, infringing, or that impersonates another person.
• Use the Service or its outputs to build a competing product or to train another model.
• Resell, sublicense, or redistribute access to the Service.

4. Subscription, billing, and cancellation

• Barddle is offered on a monthly subscription. Pricing is shown on the pricing page at the time of signup.
• Your subscription renews automatically each month until you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
• Except where required by law, fees are non-refundable. We may issue a prorated refund at our discretion.
• We may change pricing on at least 30 days’ notice before your next renewal.

5. Your content and license to us

You retain ownership of the messages, notes, and practice records you create in Barddle (“Your Content”). You grant Barddle a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process Your Content solely as needed to provide and improve the Service. We do not sell Your Content and we do not use it to train third-party models.

6. Our intellectual property

The Barddle name, logo, design, software, and content (other than Your Content) are owned by Barddle or its licensors and protected by intellectual property laws. We grant you a limited, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

7. AI-generated content disclaimer

Barddle uses large language models to draft practice plans and respond to your messages. AI outputs may be inaccurate, incomplete, or inappropriate for your situation. The agent’s suggestions are not professional advice and should not be relied on as such. You are responsible for evaluating any suggestion before acting on it. We make no warranty that AI-generated content will be accurate, safe, or fit for any particular purpose.

8. Health and safety disclaimer

Barddle is a fitness companion, not a medical service. Nothing in the Service constitutes medical, physical-therapy, nutritional, or other professional health advice. Physical exercise carries inherent risks of injury.

You acknowledge and agree that:

• You are voluntarily participating in physical activity and assume all risks of injury.
• You should consult a qualified healthcare professional before beginning any new exercise program, especially if you have a medical condition, are pregnant, or are recovering from injury.
• You will stop exercising and seek medical attention if you experience pain, dizziness, or any symptom that concerns you.
• Information you provide about injuries or conditions does not create a clinical relationship with Barddle.

9. Service availability and changes

We do not guarantee that the Service will be available without interruption or free of errors. We may add, change, suspend, or discontinue features at any time. If we discontinue the Service entirely, we will give you reasonable notice and an opportunity to export Your Content.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms or use the Service in a way that creates risk for Barddle or other users. On termination, your right to use the Service ends immediately.

11. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that any defects will be corrected.

12. Limitation of liability

To the maximum extent permitted by law, Barddle and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $50.

13. Indemnification

You agree to indemnify and hold Barddle harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules. Any dispute arising out of these Terms will be resolved exclusively in the state and federal courts located in Sheridan County, Wyoming, except where prohibited by local consumer protection law.

15. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify you by email or through the Service before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
